ProHeadshots AI is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding:

• The accuracy, quality, or suitability of generated headshots for any specific purpose
• Uninterrupted or error-free service availability
• The security of data transmission over the internet
• Compatibility with your specific device or browser
• Meeting your expectations or professional standards

AI-generated images are created using machine learning models and may not always produce perfect results. Quality depends on input photo quality, variety, and other factors beyond our control.

To the maximum extent permitted by law, ProHeadshots AI, its owners, operators, employees, and affiliates shall not be liable for any:

• Indirect, incidental, or consequential damages arising from use or inability to use the service
• Loss of profits, revenue, data, or business opportunities
• Personal or professional harm resulting from use of generated headshots
• Technical failures, data loss, or security breaches caused by third-party services (AWS, Replicate, Supabase, payment gateway, or other service providers)
• Unauthorized access to your account due to credential compromise

Our total liability for any claims related to the service shall not exceed the amount you paid for the specific order in question.

You are solely responsible for:

• Ensuring you have legal rights and permissions to upload all photos
• Complying with all applicable laws and regulations in your jurisdiction
• Verifying that generated headshots meet your professional or personal requirements before use
• Obtaining necessary consents from individuals depicted in uploaded photos
• Not using the service for any illegal, harmful, or prohibited purposes
• Protecting your account credentials and preventing unauthorized access

Specific Photo Quality Responsibilities:

In addition to the above, you are exclusively and solely responsible for:

• Uploading photos of the same person: All 1-3 photos must be of the exact same individual. You must NOT mix photos of different people (e.g., yourself, your spouse, friends, colleagues, family members). This is YOUR responsibility to verify before uploading.
• Uploading photos of the same gender: All photos must be of the same gender (either all male OR all female, not mixed). Mixing male and female photos in the same order will result in unusable output, and you will NOT be eligible for a refund.
• Avoiding group photos: Each photo must contain only ONE person (the subject). Group photos, photos with multiple faces, or photos with people in the background are prohibited and will result in poor AI training outcomes.
• Ensuring photo quality: Photos must be clear, well-lit, in focus, and properly show the face. Blurry, pixelated, heavily edited, or obscured photos (sunglasses, masks, filters) will result in poor output quality.
• Providing photo variety: Photos should include different angles, expressions, lighting conditions, and backgrounds. Uploading 1-5 nearly identical photos will result in limited output variety.

You are absolutely prohibited from uploading or generating content that includes:

• Illegal Content: Content that violates any local, state, national, or international law, including but not limited to content related to illegal drugs, gambling (where prohibited), human trafficking, terrorism, or other criminal activities
• Child Sexual Abuse Material (CSAM): Any content depicting, suggesting, or involving minors (under 18 years old) in sexual or suggestive contexts. This is strictly prohibited under U.S. federal law and international law.
• Sexually Explicit Content: Pornographic material, nude or sexually explicit images, or content intended for sexual gratification
• Non-Consensual Content: Photos of individuals uploaded without their explicit consent, including deepfakes, non-consensual intimate images, or impersonation
• Minors Without Guardian Consent: Photos of anyone under 18 years old unless you are their legal guardian and can provide documented consent
• Public Figures/Celebrities: Photos of celebrities, politicians, or public figures without proper authorization or licensing rights
• Violent or Graphic Content: Images depicting violence, gore, self-harm, or animal cruelty
• Hate Speech or Harassment: Content promoting hatred, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Intellectual Property Violations: Copyrighted images, trademarked logos, or other protected intellectual property without proper authorization
• Deceptive or Fraudulent Use: Using generated headshots to deceive, defraud, impersonate, or mislead others

If we detect or are notified of prohibited content, we will take immediate action:

1. Immediate Content Deletion: All uploaded photos, training data, and generated images will be permanently deleted from our systems (AWS S3, databases, and all backups) without prior notice.
2. No Refund: Your payment will be forfeited. You will not receive any refund under any circumstances, as outlined in our Refund Policy.
3. Account Termination: Your account will be permanently suspended or terminated, preventing any future use of our services.
4. IP Address Ban: Your IP address may be blocked to prevent creation of new accounts.
5. Legal Reporting: For serious violations (especially CSAM, terrorism, or other illegal activities), we are legally obligated to report the incident to:
   • National Center for Missing & Exploited Children (NCMEC) for CSAM
   • Federal Bureau of Investigation (FBI) or local law enforcement
   • Payment processors and financial institutions for fraud prevention and AML compliance
   • Relevant authorities in your jurisdiction
6. Legal Consequences: You may face criminal prosecution, civil liability, and other legal consequences depending on the severity of the violation.

We maintain detailed logs and may preserve evidence for law enforcement investigations.

While we do not proactively monitor all uploaded content, we employ the following measures:

• Automated content moderation systems (AWS Rekognition) to detect inappropriate content
• Manual review of flagged or reported content
• User reporting mechanisms for suspicious or prohibited content
• Cooperation with law enforcement and content reporting organizations

Our service relies on third-party providers for essential functions:

• AWS S3: File storage
• Replicate: AI model training and inference
• Supabase: Authentication and database
• Payment Gateway: Secure payment processing and transaction management

We are not responsible for the availability, reliability, or security practices of these third-party services. Each provider has its own terms of service and privacy policies.

You agree to indemnify, defend, and hold harmless ProHeadshots AI, its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these terms or any applicable law
• Your upload of prohibited or infringing content
• Your use or misuse of generated headshots
• Violation of third-party rights (copyright, privacy, publicity, etc.)
